These Terms of Use (“Terms”) govern your access to and use of Noku (the “App”) and the warzink.com website (together, the “Services”), operated by WarzInk LLC (“WarzInk,” “we,” “us,” or “our”). By using the Services, you agree to these Terms.

2) Acceptance; Changes

By accessing or using the Services you accept these Terms. We may update these Terms; if changes materially affect your rights, we will provide notice (e.g., in-app). Continued use after changes take effect constitutes acceptance. For significant updates, we may require re-acceptance in-app.

3) Eligibility & Accounts

• You must be 13+. If under 18, you represent you have a parent/guardian’s consent.
• Sign-in uses Apple. Keep your device and Apple ID secure; you’re responsible for activity on your account.
• We may suspend or terminate accounts that violate these Terms or create risk to the Services.

4) In-App Purchases, Coins & Subscriptions

• Billing. Purchases (coin packs and subscriptions) are processed by Apple. Manage or cancel subscriptions in Settings → Apple ID → Subscriptions.
• Coins. Coins are a limited, revocable, non-exclusive, non-transferable license to use features within the App. Coins are not currency, have no cash value, cannot be redeemed for money or other consideration, and may not be transferred, sold, or exchanged. All coin purchases are final and non-refundable.
• Changes. We may add, modify, or discontinue features, items, or coin mechanics at any time. We may adjust or revoke coin balances in cases of fraud, abuse, technical errors, or as otherwise necessary for business or legal reasons.
• Refunds. Refunds for subscriptions (monthly or yearly) are handled directly by Apple under App Store policies and applicable law. Coin purchases are final and not eligible for refunds. Your statutory rights (if any) remain unaffected.
• Refund effects on virtual items. If a subscription is refunded or reversed, we may reverse or deduct promotional benefits granted during the refunded period (e.g., weekly bonus coins). For randomized rewards, we may apply a reasonable average value per week to determine the deduction. We won’t reduce your coin balance below zero. If you believe a deduction was made in error, notify us at support@warzink.com within 30 days of the deduction appearing on your account, and we’ll promptly investigate and correct any mistake (including restoring coins). This does not affect your statutory rights.

Consent for refund handling: By making in-app purchases, you consent to our sharing limited consumption data with Apple solely to help them decide refund requests. We do not share message content or contact details for this purpose.

5) Entertainment-Only; No Advice

Noku is for entertainment purposes only. It is not safety, medical, legal, or professional advice and must not be relied upon for real-world decisions.

6) Acceptable Use

• Do not reverse engineer, decompile, bypass security, scrape, or overload our systems.
• Do not use the Services unlawfully or to harass, threaten, or violate others’ rights.

7) Intellectual Property & Feedback

The Services and their contents are owned by WarzInk or its licensors and protected by law. Subject to these Terms and Apple rules, we grant you a personal, limited, non-transferable license to use the App on devices you own or control. If you send feedback, you grant WarzInk a worldwide, perpetual, irrevocable, royalty-free license to use it.

8) User Content (Future-Proof)

If the Services later allow user content, you grant WarzInk a worldwide, non-exclusive, sublicensable license to host, store, reproduce, modify, and display it to operate and improve the Services. Do not submit content you lack rights to. We may remove content or suspend accounts that violate these Terms.

9) Third-Party Services

The Services may link to or integrate with third parties (e.g., Apple, RevenueCat). Their terms and privacy policies apply; we aren’t responsible for them.

10) DMCA Copyright Policy (U.S.)

If you believe content infringes your copyright, send a notice to our DMCA Agent:

Notices must satisfy 17 U.S.C. §512(c)(3). We may terminate repeat infringers.

11) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted, secure, or error-free operation.

12) Limitation of Liability

To the maximum extent permitted by law, WarzInk and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services. Our total liability for any claim is limited to the greater of (a) $50 or (b) the amounts you paid to WarzInk (if any) for the Services in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations; where they apply, limits operate to the maximum extent permitted.

13) Indemnification

You agree to indemnify and hold harmless WarzInk and its affiliates, officers, employees, and partners from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your breach of these Terms or law.

14) Dispute Resolution; Arbitration; Class-Action Waiver (U.S. Users)

• Informal resolution. Contact us first; we’ll try to resolve informally.
• Binding arbitration. Any dispute will be resolved by binding arbitration administered by JAMS or AAA under their consumer rules, before a single arbitrator in Los Angeles County, California. The Federal Arbitration Act governs.
• Class-action waiver. Disputes are resolved only on an individual basis; class actions and class arbitrations are not permitted.
• Small-claims option. Either party may bring an individual claim in small-claims court in Los Angeles County.
• Opt-out. You may opt out of arbitration by emailing support@warzink.com within 30 days of first acceptance of these Terms; include your name, the account email, and a statement that you opt out of arbitration.
• This Section does not apply to claims for injunctive relief concerning intellectual property or unauthorized access/use.

15) Export & Sanctions

You may not use the Services if you are located in, or are a resident of, a country embargoed by the U.S., or if you are on a U.S. government restricted list. You must comply with all applicable export-control and sanctions laws.

16) Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., acts of God, internet or hosting outages, strikes, governmental actions).

17) Termination

We may suspend or terminate access at any time for violations or risk to the Services. You may stop using the Services at any time. Upon termination, your license ends and virtual items/coins may be forfeited as permitted by law. Sections that by nature should survive (IP, disclaimers, limits, arbitration, indemnity) survive termination.

18) Governing Law; Venue

These Terms are governed by California law (excluding conflicts rules) and applicable U.S. federal law. Subject to the arbitration clause, the exclusive venue is the state or federal courts in Los Angeles County, California.

19) Miscellaneous

These Terms are the entire agreement between you and WarzInk regarding the Services and supersede prior agreements. If any provision is unenforceable, it will be modified to the minimum extent necessary; the remainder remains in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale. No waiver is effective unless in writing.
